Article 1 – Definitions
In these Terms & Conditions, the following definitions apply:

The Swap Club / We / Us: The organisation operating clothing, toy, book and general goods swap events.
-
Participant / You: Any individual attending an Event, bringing items, receiving points, or using The Swap Club’s services.
-
Items: Clothing, accessories, books, toys, and other goods voluntarily brought by Participants for swapping.
-
Points: Non-monetary digital credits assigned by The Swap Club based on item type and quality.
-
Event: Any swap event, workshop, or activity organised by The Swap Club, whether ticketed or non-ticketed.
-
Wallet Pass: The digital pass used to store, issue, and redeem points. Registration requires providing your first name, surname, and email address.
-
Upcycling/Recycling: Repurposing, reworking, or responsibly disposing of items not suitable for circulation.
Article 2 – Applicability

These Terms apply to all Events, the point system, Wallet Pass usage, and all related services offered by The Swap Club.

By attending an Event, creating a Wallet Pass, or using our services, you agree to these Terms.
-
Deviations are only valid if agreed in prior and in writing.
-
If any provision is invalid, the remaining provisions remain enforceable.
Article 2A – Wallet Pass Registration

To create a Wallet Pass and participate in the point system, you must complete the registration form and provide:
-
First name
-
Surname
-
Email address
-
-
Providing accurate and complete information is required for:
-
account creation,
-
point allocation,
-
communication related to Events or your account.
-
-
You are responsible for keeping your information up to date.
-
You may delete your Wallet Pass from your phone; however, to permanently delete your account and all points, you must contact us directly.
-
Upon filling out the Wallet Pass registration, you will be automatically added to The Swap Club newsletter list. You may unsubscribe at any time.
Article 3 – Participation & Tickets
-
Some Events require a valid ticket for entry, while other Events are non-ticketed. Each Event will clearly indicate whether a ticket is required.
-
For ticketed Events, participation is only permitted with a valid ticket.
-
For non-ticketed Events, participation is open under the conditions communicated for that specific Event.
-
Tickets for ticketed Events are non-refundable unless cancelled at least 5 working days before the Event.
-
Tickets may not be transferred or resold without written permission from The Swap Club.
-
You must show your ticket upon request at any ticketed Event.
-
Participation to these events is allowed only to natural persons not acting in the capacity of a profession or business (consumers)
Article 4 – Item Submission & Quality Criteria
-
You may bring up to the maximum number of items specified per Event.
-
Items must meet the following quality standards:
-
no stains, holes, tears, rips, or other damage,
-
no pilling, fading, stretching, or loss of shape,
-
no strong odours,
-
no used shoes,
-
any other quality requirements that are deemed reasonable for the intended use of an item..
-

The Swap Club performs a quality check and may refuse any item at its discretion.
-
Items not accepted may be reclaimed if they have not yet entered the swap area.
-
Items not suitable for circulation may be donated for upcycling or recycling without earning points.
-
Once an item has entered the swap area and is selected by another participant, it cannot be reclaimed.
Article 5 – Fast Fashion & Ultra Fast Fashion Policy
-
Ultra fast fashion items (e.g. Shein, Boohoo, PrettyLittleThing, Temu etc.):
-
accepted only if in excellent condition,
-
do not earn points,
-
may still be swapped by participants.
-
-
Fast fashion items (e.g. Zara, H&M, Mango, Bershka, Pull&Bear etc.):
-
must be in very good or excellent condition,
-
earn fewer points than mid-range, premium, sustainable, handmade, vintage, or designer items.
-
-
The Swap Club may update brand categories at any time and publish them accordingly.
Article 6 – Custody & Ownership of Items
-
By bringing items to an Event and completing check-in, you confirm that the items belong to you or you have the legal right to donate them.
-
You understand that custody of the items is transferred to The Swap Club for the duration of the Event.
-
The Swap Club is not liable for loss, theft, or damage to items once submitted.
-
You may reclaim unselected items at the end of the Event, subject to availability.
Article 7 – Point System
-
Points are non-monetary, have no cash value, and cannot be:
-
exchanged for money,
-
used to purchase Event tickets,
-
sold or commercially traded.
-
-
Points do not expire.
-
Points may be transferred as a gift between participants but cannot be sold.
-
Points are issued only to registered Wallet Pass users.
-
Participants receive:
-
5 welcome points upon joining,
-
5 birthday points (subject to change),
-
referral points as communicated.
-
-
Points are assigned based on item brand, material, condition, sustainability, and category.
-
Points issued at check-in are final unless a clear error is reported immediately or new insights require a reasonable adjustment of value.
-
In case new insights are discovered by a participant, points will only be adjusted if these insights are reported immediately upon discovery.
-
In case new insights are discovered by The Swap Club, we may reasonably remove the item or adjust points at all times..
-

The Swap Club may modify the point system at any time; however, previously earned points will not be removed without valid grounds.
-
In case a participant is not deemed to meet the requirement as stipulated under article 3 sub 7 of these Terms and Conditions, all points may be removed, and The Swap Club regains ownership of any items acquired by that participant.
-
Points can be removed in case any of the rules under article 9 of these Terms and Conditions are breached.
Article 8 – Use of Points
-
Points can be redeemed for items at Events according to the point values displayed.
-
The Swap Club does not guarantee:
-
availability of specific items,
-
specific sizes or categories,
-
that you will find items you want.
-
The durability of an item after the event has ended.
-
-
No refund or compensation is provided if you do not find suitable items.
Article 9 – Behaviour & Safety
-
Participants must act respectfully toward others and staff.
-
Inappropriate, aggressive, discriminatory, or otherwise harmful behaviour may result in immediate removal and a permanent ban.
-
Children must remain supervised.
-
The Swap Club is not responsible for injuries, accidents, or issues caused by items obtained at Events.
Event Safety
-
The Swap Club takes reasonable measures to create a safe environment during Events. However, Participants are responsible for their own safety and the safety of minors accompanying them.
-
Participants must follow all instructions given by The Swap Club team, event hosts, and venue staff.
-
The Swap Club is not responsible for injuries, accidents, or property damage resulting from:
-
improper use of the space, equipment, or furniture,
-
overcrowding within areas not controlled by The Swap Club,
-
actions of other participants,
-
unattended personal belongings,
-
children moving or playing unsupervised.
-
-
Items available for swapping are second-hand and may carry natural signs of wear. Participants are responsible for inspecting items before taking them. The Swap Club is not liable for issues arising from the condition or use of swapped items.
-
For the safety of all participants, The Swap Club may remove individuals whose behaviour creates risk, discomfort, or disturbance during the event.
-
Participants must alert The Swap Club team immediately if they notice any unsafe condition or incident during an Event.
Article 10 – Liability
-
All items are second-hand and exchanged on an “as-is” basis.
-
The Swap Club is not liable for:
-
damage caused by items obtained at Events,
-
allergic reactions, defects, or hazards,
-
damage to your items after the Event,
-
loss or theft of personal property.
-
-
Our liability is limited to the price of your Event ticket (if applicable).
Venue Responsibility
-
The Swap Club hosts events in various partner venues. Each venue has its own house rules, safety policies, and accessibility conditions. Participants are responsible for following the rules of the venue where an event takes place.
-
The Swap Club is not responsible for:
-
accidents, injuries, or damages that occur due to the venue’s facilities, layout, or infrastructure;
-
loss of personal belongings within the venue;
-
venue-specific issues such as lighting, floor conditions, temperature, or crowding;
-
actions or negligence of the venue staff.
-
-
Any liability related to the building, facilities, or venue operations lies with the venue owner or operator in accordance with Dutch law.
-
The Swap Club is only responsible for the activities and processes directly managed by The Swap Club (check-in, point system, swap operations), and not for conditions beyond our control within the venue.
Event cancellation
-
The Swap Club is not responsible for any cancellation of events due to:
-
Force majeure (e.g. fire, government measures, floods, pandemics, power outages, or other natural disasters)
-
Issues outside of our power
-
-
In case such a cancellation occurs, The Swap Club will arrange a replacement event, unless it is not reasonable to do so.
-
In case the replacement event cannot be hosted, participants can request a refund which will be granted up to two months after the event would have taken place normally
Article 11 – Upcycling, Recycling & Resale
-
Items not accepted or not reclaimed may be used for:
-
upcycling,
-
recycling,
-
resale via external platforms.
-
-
By participating, you give consent for The Swap Club to reuse items this way.
Article 12 – Communication
-
By signing up for an Event or creating a Wallet Pass, you consent to receiving necessary communication, including:
-
Event details,
-
operational updates,
-
point updates,
-
safety information.
-
-
Wallet Pass registration requires providing your first name, surname, and email address.
-
When you create a Wallet Pass, you are automatically added to The Swap Club newsletter. You may unsubscribe from marketing emails at any time.
-
Unsubscribing from marketing does not affect essential service communications.
Article 13 – Amendments
-
The Swap Club may update these Terms at any time.
-
Significant changes will be communicated via email, newsletter, or website.
Article 14 – Governing Law & Disputes
-
These Terms are governed by Dutch law.
-
Disputes will be handled by the competent court in Amsterdam unless mandatory consumer law provides otherwise.
